I would fight to get it totaled as it was running with no cover. I would assume even with the damage you have stated there, without the motor issue coming into play most likely the bike would have been totaled either way. Insurance companies don't like getting surprised when they go to repair a vehicle.

Yeah, you might want to make sure the engine is toast before insurance looks at it.

Sorry to hear, insurance will more then likely total the bike with the damage you described. The other insurance company contacted you I hope you stuck to your story or told them to speak with your insurance company or a lawyer, I'm seen them pull stunts where they fight you tooth and nail based on what story you told them. Other then the bike were you hurt? How did it play out?

Rest up bud, glad your ok!

+1 - don't even talk to them, have them talk to your insurance company or your lawyer. And more importantly, never let them record you on the phone.. they almost always state something like "recording for training purposes". These insurance people are trained experts at f*cking you over.

It is the mission of insurance companies to deny coverage, and if that doesn't work, to limit coverage as much as possible.

And they are VERY good at what they do!

Thanks for all the help, im in the military so the medical stuff was taken care of, im alright banged up me knee and i guess my thumb bent back and touched my forearm, but im good, the guy who came to look at it said it was more than likely totaled cuz of the engine, but its getting to be winter here, so if there is no frame damage i might try to get it back and fix it, or if there is frame damage i guess im looking for a new bike. which i hate cuz i love the one i got, but maybe a 09 would be cool. who knows. thanks again guys

They are liking not worried about the bike cost... But you suing for medical bills - pain and suffering... You'll get anything you want with respect to the bike... I he hit you from behind it 100% his fault.

I know! And yes an 09 would be VERY cool. If I were you, I'd give it a few weeks and see what's in store for the 2010 bikes. Probably nothing more than new colors, but at least you'll have more choices since 09's will still be available.

Glad you're still with us. Good luck with this situation. :beerchug:
