Nabbed by a FL Trooper...

Because of the "type of road." I wasn't on a neighborhood road I was on a road where there was no one, house, intersection, vehicles or person ins sight. I know you can't SEE the road. But it wasn't 55 on a populated roadway. It was on a lonesome country road, just horrible timing with what was coming the other way.

And YOUR road was a safe place to speed? Tree lined and a crown in the road, so that you could not see what was ahead ???
 
Not to jusge you, but that's my point. I've seen 35 mph country roads as long as the eye will see without a car or stop light in sight.

However, 25 MPH signs are typically reserved for private or school type roads.

its right next to HWY 80 no houses no schools it was a old hwy it might even be a 40 zone now that i think about it

It depends, if he wasn't running instant on radar, you probably would have gotten a weak signal before you saw him, I know, it's happened to me plenty in over the rise situations, any alert at all and I'll pull it back. Now if he was in fact hitting you with the instant on radar, the detector would have simply warning you that your about to receive a ticket.

Ba, I respect your opinion here. But surely you have to see the difference between speeds on a straight, country road with no intersections, lights and no one in sight vs an expressway or other highly populated roads with lights, driveways, intersections, other cars, etc.
 
No prob.
My biggest fear is being in your situation and having to go through all the crap that goes with it, insurance, lawyers, fines, wife bitcchin, etc... I will usually only open her up when there is zero doubt of being caught, and even then I'm wary.

Just making a point...there is NO public road where we should be doing 150+...WE do it, but take it to the track. The roads that greyrocket rides and where he got his ticket are country roads too...look at the pic he posted. They may be posted anywhere from 25-55 mph, but they are not densely populated areas.
 
thats my biggest fear of getting caught at 100+ or 30 over. JAIL i do not want to go there or lose my LIC :please:

hopefully you can get an 'excessive speed' ticket and be done with it.
in a 55 i dont think it really matters if u r traveling 152 or 102. but i could be wrong.

u said he was already turning around when u saw him. maybe he saw u a little earlier than u think.

Well bro, It seems you got caught doing something we all have been guilty of at one time or another. I am not about to pass judgement on your actions. I have to echo what was said earlier, it is a bit unbelievable that you didn't get arrested and impounded for your alledged act.
Good luck fighting it because being a rider these days equals guilty before proven innocent.
 
Over Easy: We met in Daytona a couple of years back. From what you describe briefly above this is a typical "very sloppy" Fla trooper stop. They are trained to use Radar v e r y specifically. And it is to BY LAW be used as a secondary speed measurement device. That is how they are trained as the law stipulates. Now the reality is, once class is over, Johnny Cowboy is told to go out there and write tickets. Nobody is there watching him, he forgets what he is trained to do. He knows that gun can do all his work for him and they get LAZY. I have successfully beaten all but one of my radar stops. And the one I didn't beat, I didn't beat it because the cop actually employed it correctly and I knew it when I was stopped.

From the way you describe this event, it sounds to be very beatable. And I am not trying to withold this info from everyone else, it will just take me a lot of time to type it all out. If you PM me we can exchange phone numbers and I can ask you a few basic ?s and tell you pretty much how these guys get speed stops done WAY WRONG. BTW I currently have a 160 in a 70 ticket in the Seminole County court system right now.:whistle:

Seminole county has asked for delays twice now. Maybe by Febuary (it's been over a year now) it will get b4 a judge. And for this event I did hire a traffic attorney. As soon as I subpeoned records from Seminole county they became asshatz. So I hired an attorney and now they are delaying.

I can tell you that 90% of the tickets in Fla. written by RADAR are written improperly. Not because they gun is defective.....the COP is.

I know you are analytical and you are good with numbers. I can explain in about 30 minutes how a RADAR gun works and you can go before a judge and pretty easily argue and proves thru mathematics that the cop has NO IDEA what your actual speed was, and that he didn't employ the use of the gun properly. I go with spreadsheets, the Fla state training manual, the Operator's manual for the Radar Gun etc etc in and and all the cop has to do is testify he has been trained properly (that little card they ALWAYS show ip in court with) and that they graduated high school math and then you can walk a judge thru the rest.

It isn't all that difficult to do, but granted at the speed you were ticketed at, the stakes will be higher. And dude I don't think the fine will be anywhere near as low as $500. The last one I went to court for (and won), they had some Gixxer dude at 132 with no real defense. The fines were over 1400 by the time the judge finished with him.

Not to piss you off, really. What would that do for you that easy overs eyes didn't do for him in this instance. RADAR on, detector beeps, speed registered, turn around in progress, hit zoom, proceed cautiously. Radio ahead if needed.

If caught you could have claimed you did not see him.

A trooper is not a super human being and the laws of physics were in your favour???
If you were that law abiding you should have stuck to the speed limit in the first place.

The burden of proof is on the police. He'll have to demonstrate precisely how he measured your speed. Purely an estimate based on???or radar, and if radar, what proof does he have? Its my understanding that the hand held guns require the holder to be still. Dash units work while in motion. And BTW, its hard to believe that he actually wrote a ticket for three times the speed limit w/o arresting you and impounding your bike.

depends on the model, hand held units can do both moving and stationary.
It is his option to arrest and impound. Since you pulled over immediately, probably saved you that part.
doubtful he made up the speed. He does not need to show you a thing.
It is called tracking history, he does not, and probably will not lock your speed in.
It has been my experience, locking a speed does nothing to satisfy the violator. They will argue it was not them you locked, so it is a moot issue to lock a speed.

Hope all goes your way. I too can't believe, especially in Florida, you weren't arrested and your license and bike taken right then and there!! I think you are very lucky, just hope your luck continues, Bro!!!!!!!!!!
