Lemon laws aren't that easy. I went through it with a car once. The dealer misdiagnosing the problem isn't considered a strike. It is also better to just get your original one fixed right than to go through the process. You may want to think about trying another dealer if this one is stumped.

I've seen this before. worked this very issues with the dealer several times... turned out to be - the muffler bearing. Changing that fixed it...

Damn KS. Only 400 miles? Definitely a lemon. I can see wanting it fixed if you have a lot of mods into it. If not why don't you ask for a replacement bike? The VIN might change, but it's still an Gen II Busa.

Good luck. I hope they can figure it out. I'm going to ask my service guy if he has any ideas. He's pretty good at mysteries. I've brought a few to him over the past couple of years.
