The guy that they got it back from probably told them everything to avoid a charge of receiving stolen property.
If he knew it was stolen then he's guilty too.

Be careful about how you think this. If you decided to go after them, it will come back on you. You can't commit a crime on someone because they have you. Assault charges will cost you $ to get around once they file them.

If the insurance company pays you out, then the bike belongs to them. In my case, I did not have theft insurance so the bike was/is mine.
