Owner's manual states 3.5 Qt.
Service manual states 3.7 Qt.
My Busa takes 4 Qt. to reach the full line in the oil level window (oil & filter change)

You must be leaving it on the side stand to check oil level. The level is supposed to be checked with both wheels on the ground and the bike standing up. Not on the side stand or rear stand. 3.5 has always gotten mine right on the full mark with oil AND filter change.
