He Wrecked My Bike

I decided to ride into work today as it was a nice morning. Upon exiting the Holland tunnel in Manhattan, I was blind sided by a knucklehead in a Suburban. He came up on my left side and just as he reached me he moved to the right. All I saw was a fender coming out of nowhere. He hit me and I went down while I was doing about 30mph. As usual his reason was that he didnt see me. While I was being taken away in an ambulance (as a precaution), he was lying his ass off to the cop writing the report. He told the cop I came up and cut him off and he hit me. Oh well, so now Im screwed-- my bike has been reduced to a pile of crap and I look like I was doing wrong. Thank God for my safety gear though--my injuries were limited to a little road rash on my right ankle and a sore neck. This is a wake up call for me.... I think after I fix it I will sell it. Just cant trust those around me.

Did the cop get your side of the story??

Get it to him before he writes up his report. Any witnesses??

I also got taken out by a SUV who didn't see me. But the cop wrote the report in my favor and the SUV's insurance paid for everything.

It sounds like the SUV impacted the front of your bike.  The damage should tell the story.  If you had cut-off the SUV like he said, your bike's damage from impact should be at the back of your bike.
 
Yeah, all of the damage on the left side is from his fender, bumper etc. The right side was torn off by the pavement. Thank you for the kind words, Im so upset right now I cant think straight. This was my first bike, I bought it brand new about 3 months ago and it only has 539 miles on it.
 
Even if you don't keep the bike later, fight this right away.  Worry about whether or not you'll be riding later.

sorry to hear about this...if it was me, i wouldn't just fight it, i would go after him and try to get him busted for filing a false police report...then, since he decided he didn't want to play nice and own up to his responsibilities caused by his mistake, i would take him for everything he has that i could get...if he had just said, "i'm sorry, it was my fault" and let the insurance take care of my bike, i would have let it end right there...i hate liars!!!

Wait for everything to settle down and then see what happens. He may have been lying to the cop, but the cop needs to get your side and figure out what really happened. See if he got a citation (if so, it's almost always his fault).

I know a lot of people who don't ride because of other people's poor driving! Hang in there!

I don't know about the legal issues but I'm glad you will
be o/k. Hope everything goes well on the legal end and
this arsehole gets what he deserves.
 
Cameras was a good idea, I'm sure the Holland has any number of traffic and/or security cameras.

You're riding in probably the absolute worst-case metro traffic scenario there is. Don't quit riding, just quit riding in traffic any more than you have to. I ride recreationally and when I get on the bike I'm figuring the shortest route to get the hell out of town to get somewhere that's fun to ride! Commuting on a bike is just increasing the odds for anti-chance to catch up with you.
 
The nearest camera misses the incident by about 25ft. I am fighting his insurance right now. There werent any summonses issued. The only witnesses I had pulled the classic "New Yorker" routine--they didnt have time to get involved. So it seems this is going to go on for some time. Wish me luck.
 
This is another reason why I have aftermarket exhaust. Loud pipes let you be heard. Not that it eliminates dumbasses from hitting you but it sure does cut down on people not seeing you and cutting you off. It does make a difference.

Sorry about your bike but I'm glad you were not hurt bad. Please tell me you have full coverage on your busa. Don't give up riding because of this dumbazz. I would guess almost everyone on this forum has taken a spill a time or two.
 
sorry to hear glad your ok I do that commute also same as you from Staten Island into Manhattan the merge to get into the tunnel is tough

It should tell the story all right, I want to here him explain how the damage on his left front corner pannel was caused by someone coming from behind! Going to be some kind of magic!
 
don't give up riding, even though there are plenty of a$$h*les out here, don't let them win. I got sideswiped by a lady in a lexus while she was talking on the phone. I didn't drop it, but wrinkled her passenger front & rear doors, broke a wheel cover, dented the roof and rear quarter. she took off and I followed her, along with a witness who was more upset than I was! she first said she didn't stop because she didn't realize that she hit me *note the damages listed.* finally came clean .the busa held up with just bent brackets, chips on the alt. cover and scratches. about 2 months later, I was in my escort and she almost took me out again! blew through a yeild sign talking on the phone. I never see any of these a-holes when I'm in my truck, I guess my timing is off.
