Also is the notch on the frame even? It looks like the front part of the frame (wear the chain first meets the frame) is less notched then the rest of the frame. Your bike looks sweet with that 08' tail.

yes the chain is slightly to the left. i will look into trying to jack it up

The Rear wheel is cocked and I think the chain does run a little crooked because of it. I can't tell if thats the noise or if it's hitting the frame. Plus chain is extremely tight still. It sounds like maybe I'm hearing run crooked on the front sprocket?? IDK. If I have the tire straightened it would be on the wheel tho right? Then what...

If the rear wheel is cocked it could cause everything else to not work properly.
I don't know anything about fat tire bikes but I think your first order of business should be to make sure the wheel is straight and chain is properly tensioned. You say straightening the wheel will make chain too tight. Just move the whole wheel forward a bit. This will give you addtl slack on chain, then you can straighten wheel. If that's some sort of handmade swingarm or low production unit don't count on the chain adjustment marks to be reliable.
Measure it on both sides from the swingarm pivot hole.

Looking at pic 18 and 72 it appears that the sprocket is not concentric with the hub of the rear wheel. Just the angle of the pic?
