Gen 2 Tail On Gen 1 Bike

hi i am putting gen 2 tail on gen 1 bike. i am using a D M E subframe a catalyst 6 inch over street tail extended 7 more inches by me and a mcintosh 12 inch tail support do i need to use 08 up passenger foot peg brackets or can i use the 07 down ones ? thanks
