Now onto the serious side of the subject.
Yes, anybody can use the system and send out e-mails. Doesn't matter if its legit or not. They equate this to having a phone and getting prank phone calls. Their words not mine, cause prank phone calls for the most part don't cause anxiety attacks or money!
