New Jersey State Police at their best

I don't normally defend cops but,
How many of you know what was on his mind or what he was doing at the time. You may think his actions were wrong because he was close to the other car, but it was obvious that the driver was not going to move. Just because his lights were not on doesn't mean he wasn't responding to a call. That may be the reason he didn't ticket the person.

Brake check a cop in the left lane and see what happens. It will not end well for you. A friend of mine rearended someone who did a brake check in the left lane. This was witnessed by a cop. My friend was not found at fault or ticketed and the person who did the brake check recieved several tickets, a few criminal charges went through months of investigations for insurance fraud.

I know my friend got lucky but I think you will start to see more cases like this. The last driver's saftery course I took at work list driving slow in the left/passing/fast (or what ever you want to call it) lane as aggressive driving and brake checks as road rage. This is the same class our S.O. takes.

Your friend got lucky is right. I will let you know, since I guarantee if a cop was riding my a55 like that, I'd brake check him. Then HE can spend the next few months in court proving that an animal didn't run in front of my car that I was trying to avoid.
There must have been more going on in this situation than just one single brake check. I'd really like to hear the rest of this story, but I'm afraid that won't back up your point. I'm sure there was more "road rage" involved with the brake checker..

As far as how many know what was on his mind/etc, that's a B.S. statement as well. Do you know who was in the other car, what was on his mind? What if he was taking his pregnant wife with complications in to the hospital? EVERYONE slows down when there is a cop behind him, we all know that. What if he was having chest pains? What if they just found out that their child had died? WE DON'T KNOW EITHER SIDE!
NEITHER party was right here, why are we all standing up for the person who SHOULD HAVE KNOWN BETTER?

Every class I've taken, we were told that no matter the circumstances, if you rear-end someone, it's you're fault. You can't crowd a person to the point that they don't have the option of braking. Brakes are arguably the most important safety feature on a car, and if you take the guys legal right to use them away just because someone decided to crowd him, you take his right to avoid a collision from the front by forcing a collision in the back. It really doesn't matter what the courtroom verdict would actually be, it's what the guy being tailgated thinks it will be that makes him decide to force the issue. Either way, right or wrong (legally), why does he need to take unnecessary risk of having an collision in traffic just to make this guy move over? "Didn't you see that animal in the road, officer? I love animals, and could never hurt one of them." :laugh:

From my understand the rest of the story is:
The traffic was light and the car was dirving in the left lane. My friend pulled up behind him and flashed his lights. The car brake checked him and he clipped the car as he tried to change lanes. The cop was on side of the road checking for speeders. When he came over he asked the the driver why he braked. The driver responded because he flashed his lights at me. My friend said the cop told the driver about driving in the left lane how braking hard for no reason was dangerous and he shouldn't do that. The driver started talking about his right to drive in the left, the speed limit and getting people off of his azz. The conversation went down hill from there. I don't know if the tickets or charges stuck, but my friend had to go to court several time as a witness. I am sure it cost the guy a ton of money in legal fees.

Like I said, I don't normally defend cops because in the eyes of the courts and public they are rarely wrong and I don't think that is right. But if you think you would have a chance in court, you are sadly mistaken. More htan likely, you will be trying to prove you needed to brake hard.

I dislike people driving slow in the left lane as much as people driving fast in the right lane. I am all about the flow of traffic. If we all followed a few simple rules we would have alot less congestion and problems.

I think you are wrong about the raged up people on the board. Infact, if you think it is OK to brake check someone because they are tailgating you, you are the raged up one.

Sorry, i read your comment wrong. I don't hang out in the left lane. When someone tailgates me I gradually slow down.

I think you are wrong about the raged up people on the board. Infact, if you think it is OK to brake check someone because they are tailgating you, you are the raged up one.

I'm not "raged", I'm ENRAGED at the fact that a police officer was doing this...

It's illegal to use my brakes now because somebody got scammed? BS! And my point is, it doesn't matter what the outcome would actually be, it matters what the dude doing the braking thinks should happen. Obviously there are people who think (right or wrong) that they have every right to stop their car. When that cop gets behind that guy, there will be a collision. Is that the best way for a professional to handle the situation, by daring you to let him hit you?
 
Not sure about New Jersey but Arkansas along with numerous other states have laws that say the left lane on a multi-lane highway/interstate is for passing only or if the right lane or lanes or under construction, the left lane can be used for general purposes. I am a city Police Officer so I never enforce this traffic statute simply because it rarely applies within my jurisdiction but I can promise you that if I was a State Police Officer with state highways and interstates as my jurisdiction, I would right hard copy citations all day long for this. Arkansas Statute 27-51-301(b) Motor vehicles shall not be operated continuously in the left lane of a multilane roadway whenever it impedes the flow of other traffic.

Dude...NOBODY is doubting what the law is or that people who hang in the left lane are idiots... The point of the debate has become whether the cop in this instance acted responsibly... To me and a few others on here.. the answer is most assuredly NO!!!!!

I am not saying it is illegal, but if it is suspicious you may have to explain your intentions. It used to be automatic who was at fault when an accident involved a drunk driver, but read this:

Out of curiosity, if I'm rolling 75 in the fast lane on an interstate posted 70, and a vehicle approaches at a high rate of speed (say 90), can I speed up to 90-95 to finish overtaking the half mile line of truckers? I apologize if that sounds sarcastic, I'd really like to know, as that is a very common situation. Would I be ticketed if I were in the middle of trying to get out of the fast lane when I popped over a hill and there sat a speed trap waiting for me?

Had the car in front of the Officer obeyed the law by not camping out in the left lane to begin with or simply respected the fact that someone (anyone) wanted to go faster than them and got over out of respect, the video never would've have taken place and this "discussion" wouldn't be taking place. Sometimes people forgot about the first action or first lack of action that in the end creates the end result.

Example:
Cops attempts traffic stop on a vehicle. Vehicle refuses to stop. Pursuit follows. Suspect wrecks injuring or killing someone. 100% suspect fault. Had the person stopped to begin with, it simply wouldn't have happened. But of course, it always gets twisted into being the Officer's fault. Alot of people need to move to a third world country and see how it feels to live in a lawless environment. Maybe just maybe more people would appreciate our underpaid law enforcement then. But I doubt it.

That is such a specious argument!!!! I can not believe you can really stand up and use it!!!

Does that mean that I had better not pull out to pass the half mile line of trucks that are running 60 in the right lane, because before I get around some dude running 100 might want around? This means the fast lane would never be used.

I have no problem running as fast as anyone could possibly be running in the fast lane, in order to get out of the way. Wanna run 150? Cool with me! But when I am faced with getting a ticket whether I drove too slow or drove to fast, I can't win! That sucks.
