SoCal you an I are on same page. But I'm thinking would it not be their fault for not being able to stay on the road? Can a property owner get sued because someone goes off road and hits something in their yard?

I don't know about Florida, but in California, the answer is yes. You can be sued for what would seem as rediculous reasons to any rational human being. Even if the lawsuit is unsuccessful, you have spent thousands of dollars defending yourself and good luck ever collecting court costs. Ever since lawyers were allowed to advertise their services on TV, we have become addicted to litigation. There are plenty of unscrupulous lawyers out there that having nothing to lose.
