It finally happened and it was fast

Man these folks who try to run away like that really suck...Had a friend of mine get ran right off the road about the same way...car merged in on him, ran him off the road, and never let up.....went right on like nobody's business...they suck...had my own taste of nearly getting killed back in October of last year....

Glad to see you're okay...make the insurance take care of it all...they will try to lowball you if you let them....stand your ground and don't be pressured into accepting their first offers==don't be lowballed!!!! took me over two months to get a good settlement...
Coop did you pay for the custom paint with the settlement? Do you own or make payments on your ride (as I think this factors into what my options are)?

I had a cager sideswipe me...his insurance had to pay-no fault of mine....here's the condensed version of what went down with me dealing with his insurance company..

I took my bike to my dealer to have them do a damage estimate....They estimated nearly 7800.00 worth of damage including labor costs..

I sent the damage estimate to his insurance along with pics of damage to my bike...

They estimated that it might total out my bike...I have an '06..they said that if the damage totalled at least 70% of my bikes value, they would total it...

After they saw what the dealer was estimating, they decided to send their own PRIVATE adjuster out to do the damage estimate to see if what the dealer had listed was all really damaged from the wreck-- they told me that had the dealer estimate NOT been so high (and close to the 70% totalling value), they would not have sent the adjuster out-- they would have just cut me a check

But anyway, they sent him out and he came up with figures a lot lower than the dealers...imagine that!!!

I knew from what the private adjuster quoted me that I could NOT replace all damaged items back with OEM parts...when you start trying to buy OEM replacement stuff through the dealers, it is CCCOOOOOSSSSTTTLLLLYYYY!!

So, here I was with the problem: couldn't go back with all OEM stuff--too much cost, not enough money from the insurance company..

I shopped around and just STUMBLED across another dealer that told me they had a custom painter in Memphis who could repair the gouges in my front cowlings (like you've got) by plastic weld and re-contouring...then he could do a custom paint that would make everything good to go!!!

And as you see, HE HOOKED ME UUUUUUUPPPPP!!!!

Back to the insurance---I flat out asked the insurance rep I was dealing with if I could just get the check made out to ONLY ME.......NOT ME AND THE DEALERSHIP where I had the estimate done....I told her I really didn't like how the dealership was handling helping me with the estimate and expected repair time ( they were reaaallllyyy sssllllooowww), so I thought I would seek out another repair shop...

She told me the money was mine, I could find whomever I wanted to fix it==when they cut me the check, they considered it up to me to use whomever I wanted..I was free to use whomever....

So I recommend flat out asking them the same...if you have to tell them you don't know yet who you want to fix it..you're going to do some checking around to get your best deal..tell them to just cut it to you alone...I don't know if insurance companys have different policies on this, or if state laws differ on this, you'll have to check around...or maybe just ask YOUR insurance person..tell them what you're wanting to do and what to say to the other parties insurance...that's what I did...but my insurance agent is local and from a small town, that's why I could straight up talk to him like that...use your own judgement there..

anyway, that dealership I told you I stumbled upon did the custom paint, chrome rims, chrome rear sets/foot rests, chrome stator, clutch, and oil case, polished my frame and swingarm, full Muzzy 4-2-1 exhaust for a LOT less than what it would have cost to go back with all OEM stuff

So my suggestion to you is try to get the check cut to you, and go aftermarket baby!!!!!!! You'll like the results...I promise!!!

Oh, one last thing...I work for American Eurocopter in Mississippi...been over to the plant and worked there in Arlington for 'bout three months back in '03....Dallas/Arlington/Ft. Worth area is a different world from my small town in MS, but we all have the bad drivers to deal with!!!! There are some really bad drivers there though...it was like Nascar every day from my hotel to the plant there in Arlington!!!!

glad you're ok man. thats why i never ride the interstate b/t 7am-7pm. these idiots cant drive for shid around here. its just not worth the risk

man, glad you are okay n still walkin-glad bike sounds repairable too.

read the story n MAN you really got luck-slow crash, no collisions, you walked away, cagers stopped that lying/two-faced/piece-of-s#1t c**t and MADE her wait too?----somebody gotcher back man, guess those prayers are good for something, eh?

as for insurance-my neighbor backed into my bike back in '05 n knocked it over; lonng story short his ins. compnay calls me n says "take to a SUZUKI dealership for estimate" so I rode 20+miles to dealership that also carries Ducati and Aprillia-top notch place (so i figger that they charge top$ too, n I wanted all factory plastics back...scratched whole right side, rt. bar end, peg, etc).

They stripped bike down to frame to check chassis geometry, then susp, then motor/crankcase for cracks or leaks...ended up with all cosmetic damages. I left bike there for 2 days so Ins. adjuster could go get pix of it....called me back with estimate of $1700 for all OEM parts....i agreed to this n they cut ME a check that day n said it'll be in my box in 2 days....I went to dealership took bike home, got my $1700 check, n said "you know, that was a lot of driving-why should I go without my bike 3 days, drive over 100 miles (did 1st trip to set up appt. to drop off, then returned few days later) WHY SHOULD I PAY FOR THAT?

Called ins. company up, told the guy I had been put out and felt I should be compensated for my 'lost fun' with my baby n gas/time costs too......he cuts me ANOTHER check for $75 without hesitation! worth a shot brutha-
if you ARE in pain-GO GET CHECKED OUT IMMEDIATELY! could be more severe than you realize, and ALL those doctor bills need to go DIRECTLY to that dumb b!tc#s insurance co.

Glad you are ok and Don't forget to tell your insurance co that you can save them money buy getting aftermarket parts too. Thats how I got my exhaust and a few other goodies.
 
Hey glad to hear you're OK and it was found 100% her fault. Definitely a good thing you had witnesses. I work for a big bad insurance company & if this isn't settled by now, make sure you save all the paperwork you can (i.e. police report, her information, etc). As someone earlier said, also make sure you claim all your gear...including plain clothes that may have been ruined underneath. All the way down to your shoes. Trust me they'll pay it. Don't forget to make them pay your med bills as well so you don't have a spike in your health insurance rates. That woman sounds like your typical idiot driver...
 
HT, your well written report shows us all how important it is to wear gear. You're obviously a patient, aware rider and this incident shows it can happen to anyone. Kudos to the person that stopped the person at fault. Too many people look the other way or are afraid to get involved in these situations. My advice is the same as above; talk to the insurance company about making the check out to you alone. If you owe money on the bike, the lien holder might need to endorse it, though. I'm going thru a similar ordeal, lady turned left in front of me, going 30-35, still hurt, her fault.
You need to see a Doctor... broken ribs can turn into pneumonia.
Get a lawyer, i know in Calif. the Insurance can take up to 40 days to accept resposonbility. I can image her insurance will disallow your claim just for GP, Get a Lawyer, nice guys finish last, hell she was gonna leave you lying there.....
I had $4700 damage to the bike, helmet $500 Tow and storage $600.
My insurance has covered all but my $1000 deductable, I will have to get that back from the the other party insured, big hassle.
My pipe was damaged, stock can was rated at $400, so with a few other items that were highballed, i'm getting a full system yosh.
thats about it, now if you can get a check $ and do the work yourself you can get alot of extras I suppose. I just let the dealership handle mine, they love me, there gonna make alot of $ of the repair.
 
yah man go n see a specialist,get a report on your injury ,file a claim with your lawyer advised letter together to the insurance company. make it a claim on that
 
Really glad to hear that you're OK. Hope you get your scoot back together the way you want it. I drive a big truck for a living, and the stuff I see on a daily basis is insane. Not watching where there going, changing lanes without looking, talking on sell phones. Just incredable.
 
I just kinda noticed this thread was a little old, just curious how things have turned out?
did they pay up, did you heal ok, hows the bike look?
