Got rear-ended in the car tonight.

I was heading home from a friends Halloween party minding my own business on a split 4 lane highway. I notice a deer in my lane, I get on the Brembo's and swerve into the left lane. I get around the deer and check my mirror as I knew there was another car a few hundred yards back. I've dropped down to 5th gear already and I realize he's not stopping and comin up on me quick. I mash the gas but the turbo isn't spooled so I don't get goin to fast, BAM he hits me in the right rear as I try to get back into the other lane. The damage isn't too bad from the looks of it, definitely need repair tho.
A friends father has a body shop and does some good work, so it'll be there on Monday.
I did get a ticket for unsafe lane change, which ill be fighting for sure. The cop said I shoulda hit the deer, he wasn't being mean at all, but apparently that's the laws take on it. Thats crap IMO, a 130lb deer goin through my windshield seems like something I should be able to legally avoid, we'll see how that argument goes.
Any tips for dealing with the insurance or the courts would be appreciated, never been in a car wreck before. I don't know who is considered at fault or who's insurance will be charged with the bills, I have Foremost he has Allstate.

i nearly got hit by a truck on friday while stationary at a roundabout !!

but i was on my bike and i nearly fell off when it appeared in my left mirror (proper **** myself ) started to dive right but he missed me thank god

shame about the scooby but its not too bad.


deer kill quite a few motorist's in the uk each year and the thought of one coming through the screen is not something id want to try:banghead:
 
I would think that hitting the deer would be worst:dunno: I guess the guy was also looking back at the deer and didnt have time to brake. I hope every thing works on you favor.
 
sorry to disagree with the law, but if the car was a couple hundred yards behind you, it would still be enough time to slow down to avoid the accident. (depending if they were sober)

Could of been so much worse. It's so easy to crumble cars these days. Though they are safer to drive then the older cars. Glad no one was hurt. Sorry to hear about the ticket. Hopefully you can at least get it wiped from your record for insurance reasons.
 
Take lots of photos and get copies of any of the witness statements so you can accurately tell your side of the story to the judge. Without that stuff its he said she said and if you were the one issued the ticket you would be at fault.

Cop screwed you by writing you the ticket. The other driver would have been at fault without it. It's all on you and your insurance. Beating the ticket in court probably won't change how the insurance charges it.

I thought 99.9% of the time in a rear-ending situation, it is always the rear-ender's fault for failure to control vehicle. hmm

By your own admission you were driving past the limits of your headlights, forcing you to take evasive actions cutting off the driver in the left hand lane. The driver obviously tried to miss you with the results clipping your bumper on the right corner. You had a choice of taking the left lane or the shoulder, your decision left the other driver no choice.

While I don't agree with the officer issuing you a ticket he may have had no other choice. A traffic attorney can most likely get your ticket dismissed. Good Luck! Let us know how you make out.

Thanks for the input guys, The other driver and I both did the same thing to avoid each other, which clearly didnt work out. Guess we'll see what the insuance companies have to say about it.
 
Try photoshopping a picture of the deer with ur car and the dumbass driver who hit you- you're gooood at photoshop right?! REMEMBER ME!!!! lol! Take it to the judge and see what he thinks:) But in all seriousness, tell the judge what the cop told you. I would have the cop appear in court as well to help out
