cop shoots rider in back

I don't think there could have been a rational, valid reason for shooting. Unless these guys were wanted for a previous crime where they shot @ cops or someone else. But if that was the case I don't see why the cop would holster his weapon then pull it a 2nd time. Most would keep it out if it was a serious threat. I think the cop screwed up bad.

I can't remember the name, but there was a landmark case years back where cops shot a man climbing a fence trying to escape. This was in a criminal justice class I took in college. Basically it forbids cops from shooting a perp just because they are running away. Looks like that's what happened.

As far as stopping, I would never get off bike. I got stopped 2 days ago for going 74 in a 55 on a country road. Was pulling over as copped passed me and stopped before he got turned around. Bike turned off, kickstand down, gloves off, helmet off and set under windscreen on top of triple tree, hands on my thighs. I've been stopped a couple of times and never gotten a ticket (lucky i know), and each time the cop has waited for me to take off all gear before getting out and approaching. Then I get up calmly when cop asks for license as he's standing next to me and is in control.

No excuse that was a gross display of a mishandled stop and excessive force less coffee man less coffee

WHAT THE.....!!!!!!
I mean no disrespect to Cops but when they get trigger happy, it burns me royally
I hope he gets his deserved "time"

I didn't read too much into the circumstances, but is it possible an adrenaline-charged cop mistakenly fired on the rider? Makes me want to puke when watching this video...poor guy

"It's your friend, you get the bike off"

I hope this is read before the Jury and he gets to answer for that, IMHO it makes him look like a monster and completely destroys any creditability that he may have had prior to this case. I smiply cannot believe that :poke:

I don't care for it..there on harley's there not gonna go that fast  .. I also think it could gone both ways for the officer and the rider

Wrong, cop had been following them for at least 2 min on the video, maybe longer. These guys were not running from the cops, they just got on the throttle leaving the stop sign. It sounds like they never even shifted gears, just wound it up in first. When the cop turned on his lights and siren, the guy slowed and stopped. He was just sitting on his bike, no fast jerky moves, just sitting there. I am sure with the sirens going off he could not hear anything. What bothers me is that when you see the officer first come around the door it looks like he is pulling his gun out again. if that is right, then he shot him and put his gun away and as he comes around the door and see the biker still moving he pulls his gun again. then he goes back to the car and when he comes back he has the gun pointed again at the biker. then he puts the gun away and frisked the biker, who is still pinned under the bike and probably getting burned. a minute and a half after shooting the biker, his buddy or someone else comes over and lifts the bike off the biker. Officer does help, barely, pushes it too fall over the other way. Still the officer has not tried to help the biker, stop bleeding, etc.
the Lawyer needs a bike in the court room to show someone sitting on a bike and turning back to see someone behind them. He was not moving his arm at all it, that is what happens when you turn your body around, you arm follows your shoulder.

did anyone else notice that for the three minutes the officer followed them, they stopped at stop signs but the officer rolled through them?!

This is not going to go well for the officer. It already didn't go well for the rider. Both of them will spend the rest of their lives wishing they'd done something different. The police spend a ton of money on psych profiles trying to find the right mindset to be a police officer. Too gung ho and you get this; too soft and you get shot. Tough job when you have the power to kill someone as part of the job. Would wonder how long this guy has been on the job and if he has any past history.

The sad thing, all the leo's at his trial are saying it was justified, makes me sick.

They are saying he should have kept his hands on the handle bars, blah, blah, blah, etc, etc.
What a bunch of bull

I have a lot of respect for leo's but when an officer does something like that soo fast without even thinking, just makes me pissed.

Without trying to piss off our Leos that is the course they take 99.9 % of the time, oops he made a mistake lets call it justified so he doesn't get in trouble
"that biker most likely was bad anyway" Capitol B*** S***

keep your hands on the handle bars and it looks like you are ready to run. still doesn't excuse officers attitude after shooting. frisk him while he lies there bleeding, trapped under the bike and getting burned, and then tell your buddy "if you want the bike off him, then you take it off" that is so wrong.

:agree:

They should not have ran, that's just stupid.......but there were no actions during the whole situation to justify that shooting.

Read the report, they didn't run they thought it was their friend behind them in another car...they didn't even know it was a cop! There is no defense the officer can offer to justify this shooting, this is absolutely disgusting. As much as I support the PD's, SO's and State Troopers this cop and his partner need to pay big time.

I have now seen the video, and watched the video of the person who was shot testify.

1. Those guys had to know there as a cop behind them at the light. When they gunned it at the light, mistake or not, they had already made the officer nervous.

2. The rider had his right hand on his hip, EXACTLY WHERE HE WOULD BE CARRYING A PISTOL underneath his shirt, and made a lifting guesture right when he was shot. I believe the officer had a bead on him, and when the guy made a move that could either be totally innocent, or reaching to pull, the officer made a split second choice and pulled the trigger.

3. The rider stated he was in the process of putting the bike in neutral when shot...I call BS...the bike was in neutral already, or he could not have been sitting there with his hand on his hips when shot.

After watching the video, i give the benefit of the doubt to the officer. If he made the statement in the complaint, that would be improper.

I was stopped last fall nearby; I had been speeding down a twisty road, and passed the officer. He had to go up the road a bit and turn around and come back for me, and I did not know he was behind me. He called it in as I was coming into town, and another officer came in behind me. I did not see any police for at least 4-5 minutes after I crossed this officer. I was not speeding or making any wild moves when the officer finally got close enough to pop his lights and make the stop. I had my tunes on in my helmet and could not hear any commands (or his siren; but i saw the flashing lights). I raised my arm so he'd know I saw him, calmly pulled over, turned on my emergency flashers, shut my bike off, lifted my visor , PUT MY HANDS AWAY FROM MY BODY where the officer could see them AND WAITED making no fast moves. No the officer did not draw on me as it was clear I wasn't going anywhere. When he got to where I knew he was in hearing range, I clearly told him that I cannot hear him could I please remove my helmet. After ensuring he gave me the ok, i slowly took my helmet off and removed my earbuds. When it came time to talk to him, i told him that my tunes where in my jacket pocket and asked him for permission to turn it off.

I still got the ticket only 10 over. Told him I hoped he knew I wasn't running. He said that so many sportbbikes do and the potential was there so they wern't sure until I stopped. But if he was in the mood to do a felony stop, it might have been different situation because he may not have paid any attention to me communicating I could not hear him. If he had pointed his gun at me I would have slowly put my hands on my helmet.

P.S. The complaint WORDs state "Seventy-Five Thousand Dollars" but the numbers are $750,000...You'd think a lawyer could do a better job of proofreading....

It is not unheard of for an officer to pull his gun when they meant to pull a taser. Just a thought.

Not passing judgement on either but I think we can all take from this a lesson that it does not pay to run...just stop dad gummit !

Busa1166 brings up a good point for riders lawyer.
Did cop issue any commands thru loudspeaker ?
Or did he just jump out pumped full of adrenalin and do that ?
We have all seen episodes of cops where chase ends and like 20 pumped cops pile on just cause they cant tune themselves down.

You run they get pumped and then thoughts get cloudy.

JUST STOP !

they werent running from the cop, heck i dont think they even knew he was behind them till they got on it and he turned his lights on to pursue, you can see the lights come on at the intersection, plus the time on the dash cam, what a shame.......

Well, I think the officer was wrong!! I have been pulled over and was treated like one of the worst criminals out there. Most people that get pulled over get treated the same way. I think this guy was and is to gun happy and he does not need to be in law inforsement. I know it is a tough job and the cops never know what to expect but that is why they have a way to check out plates to run a back ground to see if anything is going on with people. He could have ran the guy's plate and stayed in the car until he found out about him. I hope he gets whats coming to him but with our system today I look for him to get off. JMO
