Suzuki has emphasized that no gear is power restricted in any manner on the new 08 - i am certain this has been intentionally put as to eliminate the talk about whether Suzuki has ignition retarding for any gear except for the sixth gear RPM limit that will be responsible for keeping the bike under 186 mph.
But then again, obviously there will be a simple way of working around it, be it a gear signal interception like a TRE or a smarter and more complex way - but forget about the old days where the 5th gear map would make your bike run better at low rpm 1st, 2nd and 3rd gear - this is no longer applicable.
